I. Designation of the parties

It has been agreed between the parties that the Lessor rents the accommodation to the Lessee as described below under the following conditions:
I. PURPOSE OF THE RENTAL AGREEMENT
The parties declare that this rental does not relate to premises rented for use as a main dwelling or mixed professional use and as a main dwelling.
Consequently, they agree that their respective rights and obligations will be governed by the provisions of this contract, by the decree of December 28, 1976 modified and failing this by the provisions of the Civil Code.
The premises covered by this contract are rented furnished on a seasonal basis.
The tenant may not under any circumstances claim any right to remain in the premises at the end of the period initially provided for in this contract.
II. CONSISTENCY OF HOUSING

NB: The number of tenants may not, under any circumstances, exceed the indicated reception capacity,
- Tourist tax:
The amount of tourist tax to be collected from the occupants of the accommodation who are subject and not exempt corresponds to the product of the number of nights spent by this variable rate which is based on:
• The price of accommodation,
• The number of occupants,
• The percentage fixed by deliberation.
Amount to be collected = Number of persons subject and not exempt x Number of nights of the stay x Variable rate of the tourist tax (3% for the year 2021)
Example:
On the basis of a furnished apartment at 100.00 euros excluding tax per night occupied by 2 adults and 2 minor children.
Algorithm :
100 euros HT / 4 occupants = 25 euros HT
25 euros HT x 3% (rate recommended by the CODIR of the Tourist Office) = 0.75 euros the tourist tax rate
0.74 euros x 2 adults (only taxable persons, minors exempt) = 1.50 euros collection per night.

III. DURATION OF SEASONAL RENTAL
The Lessor rents the accommodation to the Lessee from ____ / ____ / ______ at 3:00 p.m. ___ to ____ / ____ / ______ at 10:00 a.m., i.e. a maximum duration of ______ days. The rental contract is non-renewable.

V. RESERVATION
In order to reserve the accommodation, the Lessee returns this contract initialed at the bottom of each page and signed, accompanied by the payment of a deposit up to (in numbers and letters) ________________________ __________________________________________ euros. The reservation will become effective as soon as the tenant has returned a copy of this contract accompanied by the amount of the deposit (generally 25% of the total amount).
VI. DEPOSITS

VII. REGULATION OF THE PRICE
The balance of the amount of the rent indicated in article III, either (in figures and in letters) ______________________________________________________________________euros after deduction of the amount of the deposit and the deposit, will be paid by the Lessee at the latest upon entering housing. In the event of an early interruption of the stay by the tenant, and if the responsibility of the owner is not called into question, there will be no refund, except for the security deposit under the conditions indicated below (see VIII ).
VIII. SECURITY DEPOSIT
At the latest when entering the premises, the Lessee will remit to the Lessor or his representative an amount of (in numbers and in letters) ________________________________________________________________________ euros as a security deposit intended to cover damage and / or damage to the accommodation and furniture and objects filling the accommodation caused by the Lessee, as well as the loss of keys or objects.
The security deposit will be returned to the Lessee within a maximum period of 60 (sixty) days after his departure, deduction made where applicable of the sums covering the damage and / or damage to the accommodation and the furniture and objects of the accommodation caused by the Lessee , as well as loss of keys or objects.
The deposit may be constituted by the delivery of a deposit check signed to the order of the Lessor that the latter will return subject to inventory and inventory in conformity when the keys are returned.
If the deposit is insufficient, the tenant agrees to make up the difference.
IX. ASSIGNMENT AND SUBCASE
This rental contract is concluded intuitu personae for the benefit of the sole Lessee identified at the top of the contract.
Any assignment of this lease, any total or partial subletting, any provision - even free - is strictly prohibited. The Lessee may not leave the disposal of the premises, even free of charge and / or by loan, to a person outside his home.
X. CONDITION AND INVENTORIES
An inventory and an inventory of the furniture made available are given to the Lessee when entering the accommodation.
If the inventory and inventory are not established and signed by the Lessor, or his representative, and the Lessee simultaneously (inventory and contradictory inventories), the inventory and inventory made by the Lessor alone and given to the Lessee when entering the accommodation will be open to challenge by the Lessee within 48 hours of entering the accommodation. In the absence of inventory and / or inventory at the end of the rental or if the Lessee establishes the inventory and / or inventory at the end of the rental alone, the absence of dispute by the Lessor within 48 hours of the end of the rental will be worth restitution of the premises in good condition and complete inventory.
XI. DONOR'S DECLARATION
The Lessor declares that he is the owner of the accommodation and has the free disposal and full enjoyment of it during the period defined in article III. The Lessor will justify this by producing an EDF receipt, a Land Tax notice or any other official document enabling him to prove his status as owner.
XII. OBLIGATIONS OF THE TENANT
- The Lessee will peacefully use the rented accommodation, furniture and equipment according to the destination given to them by the lease and will respond to damage and losses that may occur during the term of the contract in the premises which he has exclusive enjoyment.
- The Lessee will maintain the rented accommodation and return it in good condition to cleanliness and rental repairs at the end of the contract. If items in the inventory are broken or damaged, the Lessor may claim their replacement value.
- It must avoid any noise likely to annoy neighbors, especially those emitted by radio, television and other devices.
- The Lessee cannot exercise any recourse against the Lessor in the event of theft and depredation in the leased premises.
- He will respect the maximum number of 8 people who can enter the premises, in accordance with the description given to him.
- The lessee may not oppose the visit of the premises if the Lessor or his agent so request.
- If necessary, failing to return the accommodation in perfect cleanliness, the Lessee agrees to take at his expense the cleaning that the Lessor will be forced to carry out according to the scale annexed to this contract. (Note: the Lessee may be offered to subscribe to a cleaning package upon departure.)
XII. CANCELLATION
The signing of the contract is binding on both parties. No termination is possible without written agreement of the parties. If the Lessee renounces the rental, he remains liable for the entire rent.
XIV. INSURANCE
The Lessee is responsible for responding to rental risks and compensating the Lessor for any damage and / or prejudice involving his liability, including theft, loss, or damage to his personal objects, fire, glass breakage and damage to waters, as well as the risks of damage that it could cause on the furniture rented out by its doing or by its possible negligence.
As such, he must check whether his main housing contract provides for the resort extension (vacation rental). In the contrary hypothesis, he must intervene with his insurance company and ask him for the extension of the guarantee, or else take out a specific contract under the holiday clauses. He can take out cancellation insurance and / or comprehensive insurance covering the main risks (rental civil liability, costs of interruption of stay, repatriation, etc.).
The tenant must be able to justify the purchase of this insurance on first request. The parties agree that the lessor can never be worried in the event of theft, loss or damage to personal belongings belonging to the tenant.
XV. FULL RIGHT TERMINATION
In the event of a breach by the Lessee of any of the contractual obligations, this lease will be automatically terminated. This termination will take effect after 48 hours after a simple summons by registered letter or letter delivered by hand remained unsuccessful.
XVI. ELECTION OF DOMICILE
For the execution of the present, the Lessor and the Lessee elect domicile in their respective homes. However, in the event of a dispute, the court of the Lessor's domicile will have sole jurisdiction. This contract and its consequences are subject to French law.
XV. ANIMALS
Domestic animals, dogs or cats only, are admitted under the responsibility of the lessee after validation by the lessor within the limit of 2 (two). Failure to comply with this rule would result in immediate termination of the contract. The tenant agrees to respect the maximum number of pets allowed, indicated on the contract.
